Terms of Service
These Terms of Service (the “Terms”) govern your use of Rampsight, the white-label accessibility monitoring service available at rampsight.com (the “Service”), operated by [PLACEHOLDER: legal entity name — decide with a lawyer] (“Rampsight”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. The Service
Rampsight is an automated accessibility monitoring platform for web agencies. It crawls the websites you register, tests each page with the axe-core engine against WCAG 2.1 AA success criteria, and turns the findings into a 0–100 risk score, prioritized issue lists, reports, and accessibility statements that reference WCAG 2.1 AA and EN 301 549.
The Service is built for agencies monitoring sites on behalf of their own clients: reports and statements can carry your agency’s branding (“white-label”). You remain responsible to your clients for the services you provide to them.
2. Accounts and responsibility
To use the Service you create an agency account. You agree to provide accurate registration information and to keep it up to date. The Service is intended for business use by people at least 18 years old.
- Keep your credentials confidential. You are responsible for all activity that happens under your account.
- Tell us promptly at hello@rampsight.com if you suspect unauthorized access to your account.
- You are responsible for how you present Rampsight output to your own clients, including any commitments you make on top of it.
3. Acceptable use
Rampsight scans generate real, automated traffic to the websites you register. Because of that, this section is a condition of using the Service, not fine print:
- You represent and warrant that, for every site you add to the Service, you either own the site or have the site owner’s authorization to scan and monitor it.
- You must not use the Service to scan, probe, or monitor third-party websites without their permission, or against any site as a means of disruption or attack.
- You must not attempt to circumvent plan limits, rate limits, or other technical restrictions, interfere with the operation of the Service, or use it for any unlawful purpose.
- You must not resell or share access to your Rampsight account itself outside your agency. Delivering white-label reports and statements to your clients is the intended use and is welcome.
We may refuse to scan certain targets for safety reasons (for example, URLs that resolve to private networks) and we may suspend or terminate accounts that violate this section (see Termination).
4. Plans, payment and taxes
Current plans, limits, and prices are listed on the pricing page. The free trial requires no payment method and lets you evaluate the Service before paying.
Paid subscriptions are sold and processed by Paddle.com, our merchant of record. Paddle handles checkout, payment processing, invoicing, and the calculation and remittance of VAT and other applicable taxes. Prices shown exclude VAT, which is calculated at checkout based on your location. Paddle’s checkout terms apply to the purchase itself.
- Subscriptions are billed monthly and renew automatically until cancelled.
- Cancellations and refunds are handled as described in our Refund Policy, including a full refund within 14 days of your first charge.
- We may change prices with at least 30 days’ notice; changes apply from your next billing cycle, and you can cancel before they take effect.
5. Disclaimer — monitoring, not certification
Rampsight is an automated monitoring tool. It finds many WCAG failures, but automated testing can detect only a subset of the WCAG success criteria, and no automated tool can detect every accessibility barrier.
Scan results, scores, reports, and generated accessibility statements are not a certification, a conformity assessment, a guarantee of conformance with the European Accessibility Act, EN 301 549, WCAG, or any other law or standard, and are not legal advice or a legal opinion. A passing result does not mean a site is fully accessible, and using the Service does not by itself make any site compliant. Manual expert review and testing with assistive technologies are recommended to complement automated results.
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not warrant that the Service will be uninterrupted or error-free.
6. Limitation of liability
To the maximum extent permitted by law: we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill, arising from your use of (or inability to use) the Service — including fines or claims related to the accessibility of websites you monitor. Our total aggregate liability under these Terms is limited to the amounts you paid for the Service in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud or willful misconduct.
7. Termination
You can cancel your subscription or delete your account at any time. Cancellation takes effect at the end of the billing period already paid for; the Refund Policy describes when a refund applies.
We may suspend or terminate your access if you materially breach these Terms — in particular the Acceptable use section — with notice where practicable. On termination your access to the Service ends; data associated with your account is handled as described in the Privacy Policy.
8. Changes to these Terms
We may update these Terms as the Service evolves. For material changes we will give at least 14 days’ notice by email or inside the product before the new terms take effect. If you do not agree with a change, cancel before it takes effect; continuing to use the Service after that date means you accept the updated Terms.
9. Governing law
These Terms are governed by the laws of [PLACEHOLDER: governing law and jurisdiction — decide with a lawyer], without regard to conflict-of-law rules, and disputes are subject to the courts of that jurisdiction — except where mandatory law of your country of residence gives you additional rights or a different forum. Purchases made through Paddle are additionally covered by Paddle’s checkout terms.
